Session Information & Understanding:
This Agreement is written for Boudoir Photography.
Based off the print/product agreement, the client is agreeable to the terms, conditions,
and timeline of the session, and the delivery of images and products.
The client states that they are 21 years or older.
Model Call Session Structure.
Model Call participants will receive a complementary Boudoir photo session. The session will take place in the photographer's studio. Client understands that as the session is a giveaway, the Photographer has certain images she wishes to accomplish and
cannot take special requests for images. Clients also understand and agree Photographs taken at all sessions and presented by this photographer may be used by Anna Drwila for the purpose of public display, portfolio, advertising, website or any publication to promote her business name and the images can be used without additional compensation to the undersigned. Full names of clients are never be used. If for any reason Giveaway participant will wish to keep her/his image gallery private must pay a full
amount of the session fee £750. No pictures shall be removed until the entire amount of session fee is paid in full.
Session Retainer and Payment.
The Client shall make a non-refundable retainer in the amount of £100 for the Photographer to perform
the services specified herein. That retainer will apply as a studio credit and can be used towards further prints and products if the client wishes to purchase any additional items. Upon payment, Photographer will reserve the time and date agreed upon by both parties. Payment for additional product orders shall be submitted to Photographer on the day of the in person viewing. No products shall be delivered until the entire amount is paid in full.
£100 is due on the day of the sign the boudoir session agreement
Cash and debit/credit will be accepted.
Note that 3 digitals cannot be exchanged for cash.
If purchasing additional products / digitals - no products / digitals shall be delivered until the entire amount is paid in full.
Please be on time for your appointment. Hair & make up start at appointment start time. The session will start
at the scheduled start time even if the client is tardy or unprepared the session end time will remain the
same. The client is responsible for providing any props or outfits that are to be used within the session. Studio
will not be held responsible for additional sessions needed due to forgotten items.
In the event that the Client requests to reschedule a photographic event, the retainer shall be applied
to a rescheduled event if notice is given at least 3 days prior to the schedule event. Reschedule must be
within the same calendar year. Any Client that is late arriving to the event will have the amount of time
late deducted from the time allotted for the event. Clients shall not be compensated for the time
deducted from the event due to late arrival of the Client. Photographer maintains the right to reschedule if needed due to inclement weather, illness, emergency, etc. at no additional costs to the Client.
If Client cancels, or fails to show, this agreement 7 or less calendar days before the agreed upon
photographic event date and unable to reschedule the retainer shall be forfeited.
There are additional fees for the following: added time, additional outfit changes,
any products/prints/services not specified in the package purchased. Reference the ala carte pricing
menu for specific pricing amounts. In the event that the client specifies a certain location to be used
during the shoot, the client is responsible for all location fees involved such as location access fees,
parking, etc. Client is also responsible for arranging the location access and any permits/passes related
to doing so.Additional fees may be assessed for the adding of more than one person within this boudoir
Client Usage Rights/Copyrights:
The photographs produced by studio are protected by Federal Copyright Law (all rights reserved) and may
not be reproduced in any manner without studio explicit written permission. It is a breach of this contract
to reproduce the images in any form unless rights were purchased within the package for those images.
Client reserves the right to post images on social networking sites such as Facebook and instagram. It is a
breach of this contract to crop/hide studio logo.
These images are for personal use only, and may be reproduced for the purpose of sharing with friends and family. Commercial use of these photos is prohibited.
In the event that these photos will be published, sold for profit or used within marketing materials, the
client must obtain written permission from -- and compensate studio -- prior to the release. An additional
contract will be needed at that time.
Studio Usage Rights/Copyrights:
The Photographer shall own the copyright in all images created and shall have the exclusive right to
make reproductions for, including but not limited to, marketing materials, portfolio entries, sample
products, editorial submissions and use, or for display within or on the Photographer’s website

Completion schedules and delivery of products shall be determined from date of final approval by
Client. Third-party manufacturing laboratories are utilized for products and may provide
restrictions on an order not outlined in this agreement.
• Prints shall take 5 week from time of print order to be processed and delivered to Client.
• Albums shall take 5 weeks from date of final design approval by Client to be received by the
• Wall arts shall take 3 weeks from time of wall art order to be processed and delivered to Client.
Client should place orders with sufficient time to allow for normal delays and notify Photographer at
the time of the order if there are any extenuating circumstances requiring a quicker turn around.
An expedited fee of £200 shall be applied to expedited product requests. The Photographer shall not be
held responsible for delivery delays due to the fault of manufacturing and/or delivery services.
Use of Independent Contractor
In the event a Photographer furnishes a hair and/or makeup artist, the Photographer is not liable for
any application or services by this independent contractor. This includes but is not limited to allergies
as a result of use of the products by the Independent Contractor. It is the Client’s responsibility to
convey all allergies to the Independent Contractor and make the payment to the Hair/Makeup artist.
Use of Alcohol
The use of alcohol is permitted on the Photographer’s premises. The Client understands that
consumption of alcohol prior to and/or during the session may negatively impact the results of the
The Photographer retains the right of discretion in selecting the photographic materials released to
the client. The Client shall receive a gallery of at least 40 photographs to select from and shall not
receive any photographic materials not presented to the Client. The Photographer also retains the
right to make adjustments to the photographs in post-processing as the Photographer deems within
their creative control.
The Photographer retains creative control of the session. This control is including but not limited to the
adjustment of hair, makeup, jewelry, clothing, and clothing straps.
All photographic materials, including but not limited to negatives, transparencies, proofs, and previews,
shall be the exclusive property of the Photographer. All orders must be placed within the outlined
schedules within this agreement. No products, including digital files, will be released until the agreed
upon amount is paid in full per the payment schedule outlined in this agreement.The Photographer shall
make gallery proofs available through an agreed upon in-person product consultation. These proofs shall
be available for viewing by the Client within two weeks of the photographic event. All orders shall be
placed during the in-person consultation.
Failure to Perform
If the Photographer is unable to perform this agreement due to illness, emergency, fire, casualty, strike,
act of God or causes beyond the control of the Photographer, the Photographer and Client shall make
every attempt to reschedule the session. If a reschedule is unable to be agreed upon, Photographer shall
return the retainer to the client and shall have no further liability. Further, if the Photographer is unable
to deliver photographic materials due to technological malfunctions, including but not limited to camera
and processing, or otherwise lost or damaged without fault of the Photographer, liability shall be limited.
This Agreement incorporates the entire understanding of the parties. Any modifications of this
Agreement must be in writing and signed by both parties.
